Where Do I Start?

Get a Copy of Your Credit Reports – You are able to get a free copy of all three of your reports for free according the the Fair Credit Reporting Act (FCRA).

What Are the Derogatory Marks – What items are bad and bringing down your score?

File a Credit Dispute – you should do this with all the negative items on your report. The FCRA gives you the right to dispute any questionable item in your file.

How Do I File a Credit Dispute?

This is a letter that must be mailed to each bureau, in other words you will need to mail three letter. In this letter you need to include the item that is in dispute, the reason for the credit dispute, and any other info you have regarding this matter.

Now, the bureaus are going in conduct an investigation into your dispute. They will contact the creditor or bill collector and ask them to verify the account. If it can not be verified then it must be removed from your report. This is the effective method to fix credit.

I Hear Credit Repair Is Hard?

It certainly can be, the easiest indicator for the amount of work that needs to be done is your report. How many negative items are on there. The more items naturally the longer it will take – but no matter how many or how few items you have you can clear my credit history can remove them!

If you try to dispute the bureaus you will quickly discover why people say it is so hard. The problem is the way our credit system works – bear with me for a moment and it will quickly make sense why the bureaus avoid investigating a dispute at almost any cost!

The bureaus collect information about you. They then sell this information to lenders and businesses. Bureaus are businesses that earn profits in the billions of dollars annually. They are no different than your local bank, grocery store, retail store … their primary concern is profits. The only motivation the bureaus have to actually investigate a dispute is to comply with the FCRA. Even that is debatable because the bureaus have been fined countless times by our Federal Government.

As you can see their is no financial motive for the bureaus to investigate items and ensure they have accurate information in your file. Instead, when the bureau does investigate they are spending money that would otherwise be profit – in other words not good for business.

Therefore the bureaus have created an elaborate system of stall tactics to combat disputes. They will often ask for more information about a dispute, just to try and frustrate you. Their goal is for you to just go away and stop burning up their profits trying to get a clear credit report.

How Can You Fight Back?

Hire a professional credit repair service to clean up credit report. This can be done at very reasonable expense and you are hiring experts lawyers in Federal Consumer Laws. This is a rapidly changing area of our legal system.

If you hire a credit repair service all you do is forward them your credit reports and indicate what items you want them to dispute. Next you will start to get investigation result letters, these will tell you if an item was verified or not and if it has been removed from your report. Forward these letters on to your service and begin to enjoy the benefits and lifestyle that a good credit score can provide.

Call 1-800-768-3386 for a free no obligation credit consultation – and begin the processes to fix my credit score.

What You Should Look For

The world of credit repair has been quickly evolving. In the past many companies and lawyers could ‘game’ the system and improve a clients credit – however they would also charge outrageous fees! Follow the steps below to avoid a fraudulent company or a company that may be working in a gray area or out right breaking the law to fix your credit.

1. Small Up Front Fee – sorry to break it to you but it is going to cost you money to hire a professional to fix your credit. You should look for no more than a $100 up front payment and then a monthly fee in the area of $50 – $100. You should anticipate at least six months. We have seen some lawyers charge people thousands of dollars!

2. How Long Have They Been In Business – this is a good indication of how law biding the credit repair company or credit repair law firm you are looking at is. If they have been doing this for a long time then you can trust them more then a company that just started up. Further, the bureaus have identified some law firms and will not acknowledge or respond to a dispute from them!

3. What Do Old Clients Say – what does someone say about their experience with this company? Did it work for them? Were they happy with their results?

4. No Guarantees – when it comes to credit repair, nobody not even credit lawyers can make any guarantees. Instead look for a refund policy.

How Does It Work?

1. You need to get a copy of your credit report from each major credit bureau. You can get a copy for free each year by visiting annualcreditreport.com.

2. Forward all three credit reports to the credit lawyer.

3. Identify what items you want them to file a credit dispute for and sit back.

4. Receive your investigation result letter from the credit bureaus. Here you will be notified the result of the investigation; if the item was verified by the lender, removed from your report, … Forward this on to your credit lawyers and sit back and relax. Enjoy opening your mail and seeing the items removed!

Can I Do It Myself?

Yes, you can repair bad credit yourself. You absolutely do not need to hire someone. Just want to caution you before you begin to make sure you are prepared to persevere and to stay organized.

This is because the bureaus make it very difficult for you and anyone to dispute a negative item. This is because the bureaus must spend money that would otherwise be profit conducting an investigation. Therefore they have developed a sophisticated response method.

Typically your dispute letter will be responded with by a letter requesting more information about the disputed item. This is just an attempt to frustrate you, in hopes of you giving up on fixing your credit.

Additionally you must file a dispute letter with each credit bureau. For example; if you have a credit card that charged off on all three reports you must write a dispute letter to all three credit bureaus. Just writing to one bureau may remove it from that report, however the other two bureau will still have it on their report.

We would suggest you go ahead an try if you would like to do it yourself and we wish you the best of luck – however we would also encourage you to use a credit repair service as it can be used at a very reasonable rate and eliminates the work and guaranteed headache you will encounter! That is the one guarantee that can be made!

Plus they are experts in this industry – it’s their job and your credit score influences – where you live, what kind of car you drive, your ability to make purchases, the embarrassment or pride you feel when your credit is checked … and so so much more!

We would encourage you to look at Lexington Law – they removed over a million items from their clients reports in 2010 alone – they have 20 years experience in the business with 22 expert credit lawyers and paralegal’s to work for you! For a free credit consultation call 1-800-768-3386

Who Are They?

Professional credit repair services are typically a group of attorneys that are experts in the federal consumer credit laws. These laws are constantly evolving and so are the ways to improve your credit score.

What Will They Do?

This service will file credit disputes on your behalf. This is how it works:

You get a copy of your credit report from each bureau – you are entitled to one copy of your report from each bureau every year according to federal law and you can request this at: annualcreditreport.com

Forward all three reports on to your credit attorneys – on your report you need to indicate what items you want to dispute (all the negative ones – more on this later but it is 100% legal)

Sit back and open the investigation results – now you just wait for the results to happen. You will start getting letters from the credit bureaus indicating the results of their investigation.During an investigation the bureau will contact the lender or debt collector and ask them to verify the account – if they are unable to verify it then the item must be removed from your report.

Forward these investigation letters on – and continue to practice financial responsibility and enjoy the new life that a good credit score can provide!Maybe you can finally purchase a home, purchase a car at reasonable interest rates, get a reward credit card – and you need to celebrate no longer being ashamed or embarrassed when your credit is checked – instead you can feel proud of those three little numbers!

I Thought Credit Repair Was Illegal?

NOT TRUE!! This myth along with the myth that you just have to live with bad credit are just that myths! The Fair Credit Reporting Act (FCRA) is what these individuals are referring to when they say ‘you just have to live with bad credit’ – however this act only spells out a maximum amount of time an item can be on your report that being seven years!

This legislation says nothing about the minimum amount of time an item can remain. Further the FCRA is what gives you the right to dispute any item on your report that you “feel” is inaccurate. You will never face any legal repercussions for disputing a mark that you know to be accurate.

But if you really want to get down to the nitty gritty – these items are almost always inaccurate. Why? Because interest rates are added in, collection agencies will charge fees for trying to collect the debt, and the dates are often extended. For example, if you had a credit card and stopped paying on it 1 year earlier and the credit card charged off.

Now three years later lets say a collection agency just bought your debt, for literally pennies on the dollar. However they may see this account as brand new to them and give you a whole new negative entry on your report that will also last for seven years. You can see how one item can end up remaining on your report for much longer than seven years as debt accounts are sold to many collection agencies over a period of years – by law this one item started aging when you stopped paying the credit card company.

Can They Do Anything Else?

Beyond being experts with dealing with the bureaus and giving you peace of mind that you have a professional credit law firm that are experts in federal consumer laws working on your behalf. To answer the question, yes they can do other things if needed.

With the power of an Attorney you can also use; court intervention, debt inquiry, goodwill intervention, and debt validation. The last one being one of the most powerful. If you are being contacted by debt collectors you can use this and it will force them to provide legal evidence that they own your debt – you would be shocked at how often a debt collector is unable to do this simple task, in which case you don’t have to pay the debt and the item will be removed from your report once it is disputed.

Stop living with damaged credit, stop paying high interest rates, stop feeling embarrassed when your credit is checked and take action to remove these negative marks.

You can also enjoy the benefits a good score will provide such as being able to finance purchases, pay low interest rates, and even earn points with reward credit cards – Best of all you can finally be proud when someone checks your credit! The best credit repair service we have found is the Lexington Law Firm Credit Repair Service.

The have been in business for over 20 years and in 2010 they removed over 1 million negative items from their clients credit reports – for a free credit consultation call 1-800-768-3386.

Are you paying the high cost of bad credit? Are you embarrassed and humiliated when your credit is checked? Then take action and follow the steps below to get a clean credit report.

Steps to Clear Credit

Get Your Credit Reports – You need to get each bureaus report. In other words you will get three reports in all – this can be done for free annually by visiting annualcreditreport.com

Dispute Negative Items – You can write a dispute letter to challenge the accuracy of the negative items on your report. In your letter you need to include the item in question, the reason for the dispute and any documentation you have. Once the bureau deems your credit report dispute valid they will investigate it. They will contact the creditor and ask them to verify the debt exists, the amount, and the dates. If the creditor can not verify your account then the bureau must remove the item and clear bad credit.

Wait For Investigation Results – You will get a letter from the bureaus once they complete their investigation. This letter will tell you if the account was verified or if it has been removed from your report.

What Items Can I Legally Dispute?

Good question – you can dispute them all and it is 100% legal to do so! The standard an item must meet for you to be able to dispute it, is that you feel it is inaccurate. Many of these items are inaccurate too, they have an inflated balance, the dates are wrong, the item was put on your report by mistake.

It is estimated that 1 in every 4 reports have a mistake on them, this mistake could be costing you money. We would encourage you to dispute every negative item, you will never face any legal prosecution for disputing an item you knew to be accurate.

Many Items Are Not Verified and Removed

Fortunately once you get the bureau to investigate you have a really good chance at getting the item removed from your credit file. This is because many businesses are unwilling to spend the money to verify a debt they have already accounted for.

For example, if you have a credit card with Capital One and stop making your payments. Eventually the credit card is going to charge off. This means Capital One is no longer trying to get payment from you. They have written your account off as a loss for tax purposes and then sold your debt account to a collection agency.

Now you will only be contacted by the collection agency regarding this debt, however on your report it will show that your Capital One card was charged off. If you dispute this and the bureau investigates it they will contact Capital One and ask them to verify the account.

Capital One is not going to because why are they going to spend the money to have someone look up an old account. Capital One has gotten payment albeit from a collection agency but Capital One has no more concern for your account. They have gotten everything they can from it and are not going to spend more money and time to verify it. Therefore the bureau will be forced to remove fix your bad credit.

The hard part in this process is going to be getting the bureaus to deem your dispute valid and actually investigate. Please be persistent and follow through or you can hire a professional credit repair lawyers.

LVNV Funding, LLC is a bill collector agency who buys old unsecured debt and comes after people who they believe owe them money.

Creditors such as credit card companies and other financial entities sometimes hire collection agencies like LVNV Funding to collect debts for them, because they simply don’t have the time or resources to chase down all of their overdue accounts.

Collection agencies often have access to cheap labor in other countries and a streamlined system to pursue such accounts. When a creditor hires a collection agency, the debt has been assigned to the collection agency. If a collection agency is successful at collecting the money on the account, they usually keep a percentage of what is collected as payment for the services.

In my case, I had no idea whether LVNV Funding had bought my Sears retail debt or were working for Sears and sharing the amount they collected. I had no idea who legally owned the debt and the bill collector refused to tell me that information.

I know that often original creditors sometimes sell debts in large portfolios to collection agencies. This practice is becoming the normal way of doing business, and a very lucrative one at that. Known as Junk Debt Buyers, they are now being traded on Wall Street.

Paying less than 1 cent on the dollar, if the debt is collected they can make up to 150% profit. Even if the debt is not a large debt, they often hire attorneys to send out mass form letters to debtors in the hopes of collecting.

You are entitled under the rules of the Fair Credit Reporting Act to write a Debt Validation Letter, asking for verification of the debt within specific parameters. How they claim the debt is yours, how much, and when it became collectable should all be included in the letter. They are not allowed to collect the debt if they cannot verify it.

I used Lexington Law to handle the debt validation because it is a little more complicated than sending out a simple dispute letter. They are an affordable, effective, and trusted credit repair service that has been working in the industry since 1991!

Sometimes a collection agency such as LVNV will respond to your letter with a summons to appear in court, which means they are trying to file a judgment against you. This is also illegal as precedent has been filed with the US Supreme Court that determines a collector cannot get a judgment until they have validated the debt.

For debt validation specifics, give a credit repair paralegal a call: 800-768-3386. The call is free and they can explain how debt validation works.

Can LVNV Funding LLC Collection Agency legally collect a debt from you? Or, is it all just a big scam?

There are creditors who are rapidly becoming part of a very lucrative collection process, which means the debts owed them are assigned rather than sold. There is a big difference between whether a debt is assigned or sold.

Original creditors are now assigning debts to collectors because they don’t have the time or the funds to chase down all the people that may owe them.

Collection agencies seem to produce an endless source of revenue, churning out collectors from other countries and using techniques that seem like they came out of a textbook. By the way, most collection agencies now school their labor force in the art of aggressive collection techniques while coming close to skirting the brink of breaking the laws that protect consumers.

For instance, ex-collection agents from various collection agencies claim that if an agent is able to bully a debtor into paying a debt that he or she might not legally owe, the agent gets a bonus and the company makes a huge profit!

The fact is, if a debt is assigned, the collection agency is not legally the owner of the debt. In other words, unless the agency proves that it purchased the debt, you might not even feel the need to acknowledge them.

On the other hand, you should read your contract that you signed when you first incurred the debt. Some contracts have wording like this:

“debtor agrees to be responsible for the payment of this debt to creditor or its assigns…”

The “assigns” part of that language refers to a third party collection agency such as LVNV Funding Collection Agency.

But even if they prove that they have purchased the debt outright, they are still bound by the rules of the FDCPA. There are portions of the FDCPA that allow you some relief from collectors.

For debt validation specifics, give a credit specialist a call: 800-768-3386. The call is free and they can explain how debt validation works and how you can remove bad credit from your credit report.

There are two steps you should take to repair your credit score.

Remove Bad Credit

Create New Positive Reporting Credit Lines

1. Remove Bad Credit

The bad credit items on your report are bringing down your score. When your score is calculated it will look at your; debt, types of credit, length of credit, diversity of accounts, frequency of inquiries and your payment history.

Your payment history accounts for roughly 35% of your overall score. By removing negative items on your report and paying your current bills on time you will create a positive payment history and improve credit score.

To remove negative items from your report you need to file a credit dispute. This is a letter you mail or your credit attorney will on your behalf. In this letter you indicate what item you are challenging, the reason it is inaccurate, and any other related documentation.

When the bureaus deem your dispute valid they will conduct an investigation. They will contact the lender and ask them to verify your account, the dates on it, and the amount. If the lender is unable or unwilling to do this then the bureau must remove the item from your report and you will be one step closer to repair my credit rating.

2. New Positive Credit Lines

This also includes paying your current bills on time but if you can qualify for new credit we would encourage it. This is because as you pay that bill on time you are creating more evidence that you are a safe risk with a positive payment history and you will see an improved credit score.

This is related to the amount of debt you have. With the credit score formula your amount of debt also called credit to debt ratio will account for about 30% of your score. Obviously, the less debt you have the better but even if you have huge sums of debt you can still have a high score. For example; student loans, auto loans, mortgage … these won’t hurt you too much.

Where you should focus your effort is to ensure that your credit card is not maxed out. If all your credit cards have a balance near their limit your score will go down. Instead you need to show the bureaus that you have available credit and are a responsible borrower and just don’t need it.

The easiest way to do this is to try and keep your credit card balances at roughly 30% of the limit. This will make it appear that you do use your credit but use it responsibly as you are not using every available dollar to borrow.

Why Do I Hear Credit Repair Is Hard?

There are a number of reasons for this however the most obvious is because the bureaus will not deem your dispute valid. The bureaus do not earn money by fixing your credit and instead they burn money that would otherwise be profits.

Thus, the bureaus are very reluctant to conduct an investigation and must first deem your dispute valid. This can be a never ending headache – which is the bureaus goal – they hope you will just give up.

You should persevere because you do not just have to live with bad credit or you can always turn to a professional credit law firm to help you deal with the bureaus. They can be hired at very inexpensive rates – about $100 up front and $50 a month for about 6-12 months. This expense compared to a bad score – is really a no brainer.

We recommend the Lexington Law Firm – in 2010 they removed over 1.2 million negative items from their clients reports. Additionally they have been in business since 1991, and stand by the results they have provided their clients.

LVNV Funding is a collection agency with very unorthodox reporting practices. Debts that are not yours could be sold to this agency and placed on your credit report, solely for them to make money. Amounts can be inflated or padded, and are very hard to remove without legal credit help.

One of the first things you can do to fix my credit is to write a dispute letter, a template of which is listed below. Write to the three major credit bureaus which report your credit status. They are Experian, Trans Union and Equifax. Always make copies of your correspondence and send it certified, return receipt.

————————————————

Date

Dear Investigator:

This letter is being sent to you in response to a notice sent to me on <Month Day, Year>

Please be advised this notice is sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

Please provide me with competent evidence that I have any legal obligation to pay you by answering the following:

• What the money you say I owe is for and how you calculated that figure
• Provide me with copies of any papers with my signature
• Documentation to prove the SOL has not expired on this account
• Show me that you are licensed to collect in my state.
• Provide me with your license numbers and Registered Agent

If you are not able to provide me with this information within 30 days, then you are committing fraud and I will bring legal action against you. If you produce documentation, then I will require 30 days to review it.

This is an attempt to correct your records if the information is wrong; any information obtained shall be used for that purpose.

Regards,

Your Name

————————————————

Good luck and don’t get discouraged. They are counting on the fact that you will give up and just go away. However with some persistence and determination you can clear up your credit.

What Do I Need To Do?

Get Your Credit Reports - the very first thing you must do is get a copy of your credit files. You can do this by visiting annualcreditreport.com – this site will provide you access to one free copy of your credit report from each bureau for free – one per year – this is federal law.

Questionable Items- you need to identify any and all marks that you feel are inaccurate. Contrary to popular belief you can dispute every single item on your report so long as you feel it is inaccurate. This is according to federal law and there has never been a consumer to face legal repercussions from disputing an item.Further you can feel this item is inaccurate for any number of reasons; the dates, the debt has been paid, the balance, you don’t remember, you don’t agree with it …. You will never have to worry about any consequences for filing a dispute. The law that gives you this right is the Fair Credit Reporting Act and it was passed to protect you from the bureaus and aggressive debt collectors.

Write a Credit Dispute Letter - in this letter you need to include the item you are challenging, the reason, the dates, and any other relevant information. You will need to mail this letter to all three credit bureaus. In other words you will have to mail 3 letters, one for each bureau.

Investigation - once the bureau deems your dispute to be valid they will investigate it. They will contact the lender and ask them to verify the account. If it is unable to be verified then it must be removed from your report.

I Thought It Was Hard To Remove Bad Credit?

It certainly can be. And many individuals either give up and continue to suffer the high cost of a damaged report but the intelligent ones turn to professional credit repair companies to do it. It is difficult for a few reasons lets start with what happens after you send off your credit dispute letter.

You will often get a response from the bureaus asking you for additional information. Sometimes they made need it but more often than not this is just the standard operation procedure to handle a dispute.

Next, you will be strung along like this through a few correspondences and if you are persistent and diligent you will probably succeed in eventually getting the bureaus to investigate your dispute. The other alternative is you may get a red flag on your account which will make disputing this item in the future incredibly difficult!

Don’t The Credit Bureaus Want Accurate Information?

To put it bluntly they don’t give a flip! The bureaus do not sell your information to other consumers, instead they sell it to businesses and lenders – that is who pays the bureaus bills and create’s their profits!

When they do investigate an item it only costs them money and money that otherwise is going to be profit. The only incentive the bureaus have to investigate disputes and even allow people to dispute their report is federal laws.

The bureaus have violated these laws countless times and have faced fines over and over again from the FTC. While the FTC may be leveling million dollar fines to an industry that annually is earning billions of dollars this seems like little more than a slap on the wrist – but this is the state of our credit system and you are going to have to work within it.

The major bureaus have come up with an extensive and frustrating road to get a dispute investigated. They do this because it is cheaper to just blow you off as you are seen as just a pesky consumer that wants to eat up their profits. Instead of a hard working, tax paying citizen that is suffering from inaccurate items on your report – in fact it is estimated that 1 in every 4 reports have an error on them.

If you find yourself frustrated with trying to get your disputes investigated then we would encourage you to research hiring a professional credit repair lawyer. They can be used at a very reasonable rate – typically $100 up front and a monthly fee around $50 with a typical time length in the range of 6 – 12 months.

This will provide you with expert knowledge and tools to battle to fix your credit history. If you hire a credit law firm you can also take advantage of additional tools; debt inquiry, debt validation, goodwill intervention, and court intervention.

For more about how to file a credit dispute and how to repair bad credit call 1-800-768-3386 and get a free credit consultation – and take the first steps to a 700 credit score.
